1. Acceptance of Terms

By accessing this website, you agree to these Terms. If you do not agree, please do not use the site.

2. The Parties

Clear Studios is a consumer-facing brand used to market and administer a membership-based dental program. Clinical services are provided by Perfect Smiles and Orthodontics, PLLC ("the Practice") and appropriately licensed dental professionals. Clear Studios markets and facilitates enrollment in the membership; the Practice delivers all clinical care and is solely responsible for the standard of that care.

Corporate office: 301 W Atlantic Ave, Suite 5, Delray Beach, FL 33444. Clinical services are currently available at our Fort Myers, FL operating location, with additional locations to follow.

3. Services

Clear Studios is a consumer-facing brand. Clinical services are provided by Perfect Smiles and Orthodontics, PLLC and appropriately licensed professionals. Services are subject to clinical eligibility, availability, and applicable terms.

4. Membership Overview

The Clear Studios Membership ("Membership") is a subscription-based dental membership program that provides access to preventive dental services and discounted pricing on additional services as outlined in your membership plan. The Membership is not insurance and does not replace comprehensive general dental care or emergency dental treatment. Membership benefits have no cash value, are not transferable, and do not replace medically or dentally necessary care. Cosmetic polishing is not a preventive prophylaxis or periodontal treatment. Unused services do not automatically roll over unless the final membership agreement expressly provides otherwise.

5. Membership Activation & Billing

Membership billing begins only after activation, acceptance of the membership agreement, and separate authorization of recurring payment. Members may cancel through the same online method used to enroll. Cancellation and refund rights are governed by the separate Membership Terms provided at enrollment. In the event of any conflict between these Terms and the Membership Terms, the Membership Terms control with respect to cancellation, refunds, and billing.

6. Clinical Eligibility

All services remain subject to clinical eligibility. A treating provider at the Practice will determine whether a given service is clinically appropriate for you. Membership does not guarantee that any particular treatment will be available or clinically indicated. Services outside the Clear Studios scope are referred appropriately.

7. Pricing & Payment

Advertised treatment prices are minimum fees unless expressly stated otherwise. Membership fees are charged according to the payment plan selected at enrollment (annual or monthly). All prices, including membership fees and add-on service pricing, are subject to change at any time; material changes will be communicated with advance notice as required by applicable law.

8. Clear-Aligner Treatment

Clear-aligner results and treatment duration vary based on individual patient factors including compliance, anatomy, and treatment complexity. A digital Smile Preview is educational and does not constitute a diagnosis, prescription, final treatment plan, or guarantee of results.

9. Third-Party Financing

Third-party financing options are available subject to approval and provider terms. Approval, rates, and monthly payments are determined by the financing provider. In-house payment plans are also available for qualified members.

10. Limitation of Liability

To the fullest extent permitted by law, Clear Studios' liability for the marketing, administration, and facilitation of the Membership shall not exceed the amount you paid for Membership in the current billing period. Clear Studios does not replace comprehensive general dental or emergency care. Clinical decisions remain with the treating providers. Nothing in these Terms limits or excludes the Practice's professional liability for clinical care, and nothing herein is intended to waive any non-waivable patient rights, including rights related to professional negligence, informed consent, or the standard of care owed by a licensed dental provider.

11. Health Information

This website does not collect, transmit, or store protected health information. Any clinical or health information needed for your care is collected and managed through a separate HIPAA-compliant electronic health record and practice management system operated by the Practice under an appropriate Business Associate Agreement. 12. SMS Communications

Text messaging is governed by our SMS Terms & Conditions.

13. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms. Material changes will be communicated via email or in-app notification at least 30 days prior to taking effect.

Membership Disclaimers

* “Unlimited cleanings and whitening” are subject to clinical approval. Modern smile-care membership with benefits stated in your selected plan. Benefits may include eligible professional polishing or preventive care, whitening, examinations, diagnostics, oral-health saliva screening, and member pricing on designated services. Cancel anytime. No insurance required. All services are subject to clinical eligibility, availability, and the Membership Terms.

Cancel anytime. Cancellation stops future recurring charges. The enrollment payment and completed monthly payments are nonrefundable, except as required by law or for a verified billing error.

Membership is not dental insurance. Clinical benefits remain subject to professional evaluation, eligibility, availability, and the Membership Terms. Certain eligible expenses may qualify for HSA/FSA payment; confirm eligibility with your plan administrator.
